Terms of service

Last updated: 【DATE】

Welcome to Patina & Grace. These terms cover your use of this website and any order you place through it. When you shop with us in the store, the terms posted at our register and printed on your receipt apply — including that all sales are final and every item is sold as is. By using this site or placing an order here, you agree to these terms.

About us

Patina & Grace, LLC is a family-run flea market and antique store at 17186 Highway 70, Benton, Arkansas 72019, between Benton and Hot Springs. Around forty independent booth vendors rent space from us, and we ring up and stand behind every sale. You can reach us at 501-545-3977 or png@patinangrace.com, Monday through Saturday, 10am to 5pm.

Our items

Most of what we sell is antique, vintage, or one of a kind, and quantities are usually one. We describe and photograph items as accurately as we can, including honest wear. Colours can look different from screen to screen, and age-related wear such as patina, small chips, or crazing is part of a vintage piece rather than a fault.

Because our stock turns over constantly, an item shown on this site may sell in the store before an online order is processed. If that happens we will contact you promptly and refund that item in full, including any shipping you paid for it.

What we promise, and what we don't

Everything we sell is sold AS IS AND WITH ALL FAULTS. Because our pieces are old, previously owned, and one of a kind, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

What we do stand behind is what we actually tell you. If we describe a piece's age, maker, materials, or condition, that is our honest best knowledge, and if we get something wrong we will make it right. If we know a piece has been damaged by fire, water, flooding, or an accident, we will tell you.

Vintage items are often decorative and were not built to modern safety standards. Old lamps and anything electrical, painted or finished furniture, and children's furniture in particular should be inspected — and rewired or refinished where needed — by a qualified person before you use them.

Pricing and availability

Prices are in U.S. dollars and may change at any time, but a change never affects an order we have already accepted. Prices do not include sales tax; Arkansas sales tax is added at checkout where it applies. If an item is listed at an obviously incorrect price, we may cancel the order before it ships and refund you in full rather than complete the sale.

All sales are final

Because our pieces are unique, all sales are final except as set out in our Refund Policy, which controls on refunds, cancellations, and damaged items. That policy also explains what to do if an item arrives damaged, when we will cancel an order and refund you in full, and what happens if we cannot ship your order on time.

Ordering

To place an order or open an account you need to be at least 18. Some items may carry age restrictions, and we will say so on the listing. Delivery, pickup, and timing are covered in our Shipping Policy.

Booth rental

【CHOOSE ONE — SEE NOTE BELOW】

Renting booth space is a separate arrangement between Patina & Grace and each vendor, and it is not governed by these terms. Nothing on this website forms, changes, or replaces a vendor's rental arrangement with us. If you are interested in a booth, please get in touch.

Your account and conduct

If you create an account, please provide accurate information and keep access to your email secure — that is how you sign in. Please do not use this site for any unlawful purpose or in a way that interferes with others using it. We may close an account that is being used for something unlawful or abusive.

Our content

The text, photographs, and logo on this site are owned by Patina & Grace or used with permission, and may not be reproduced for commercial use without our permission. Booth vendors who give us photographs of their items give us permission to use them to promote the store and to list those items.

If something goes wrong

Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, or for fraud or intentional misconduct, and nothing here limits any right you have that cannot be waived under Arkansas or federal law.

Subject to that, and to the fullest extent Arkansas law allows: we are not liable for indirect, incidental, or consequential damages arising from your use of this website or from an item you purchased, and our total liability for any claim relating to an item will not exceed what you paid for that item, including any shipping you paid for it.

Arkansas law

These terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-law rules.

If we ever have a disagreement we cannot work out together, you and Patina & Grace agree it will be brought in the Circuit Court of Saline County, Arkansas, or — if the amount involved is within its limits — in a District Court of Saline County. We each consent to those courts hearing the matter. If a claim can only be heard in a federal court, it will be brought in the United States District Court for the Eastern District of Arkansas, Central Division, which is the federal court that covers Saline County and which sits in Little Rock.

The rest

If any part of these terms turns out to be unenforceable, the rest still applies.

These terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, are the whole of the agreement between us about this website and orders placed through it. They do not affect any separate agreement you may have with us, such as a booth rental arrangement.

Changes

We may update these terms from time to time. The version in effect when you place an order is the one that governs that order, and we will always note the date these terms were last revised.
